Never Ever give up. The Ripp Report has been reporting, and going to court, related to the Publix project before the Mayor or any of the Council were elected in Fairhope. The present council refused to take any action on behalf of the citizens, which they could have done, involving the Fly Creek Apartments. The council explained there was nothing they could do to stop the apartments or enforce any of the city’s ordinances that may amend the approved MOP Site Plan.
The City Council sided with the developer and the Mayor’s hands were tied because the council rejected her pleas and turned a deaf ear to caution.
This, Victory, is for the citizens of Fairhope and should be a shining example of what citizens, and a damn good attorney, can accomplish when citizens are abandoned by their elected officials.
The attorney, Adam Milam, should be commended for his many years spent on 4 separate lawsuits involving the Publix and Apartment Complex. He has spent countless hours studying planning and Zoning regulations, ordinances and building codes, plus a ton of court time. I am sure he knows more about this subject now than he ever thought he would when he first started this battle. If you live in a municipality where your City Council supports developers over the right of the citizens, I would highly recommend Attorney Adam Milam, congratulations Adam.
My participation as President of The Fly Creek Watershed Preservation Association Inc., was that of a consumer advocate.
Let us all see what action the council takes now that they have to revisit the a new MOP Site plan. The Council owes the citizens an explanation but do not hold your breath because this was their mistake, not following their own laws.
“The Fairhope Planning Commission, when it approved the MOP Site Plan acted inconsistent with Ordinance 1572 and therefore, acted arbitrary, capriciously, and not in compliance with applicable law.”
Francis Paul Ripp President Fly Creek Watershed Preservation Association,Inc.
Oh oh, Ripp. You are going to make the Carysts mad at you
Great victory for The Ripp Report on behalf of Fairhope residents! The Fairhope City Council’s lack of integrity has worn most of us to the point that we have almost given up. Thank you to both you and Adam Milam for fighting the ‘good fight’ for the good of the City. This may be the ‘Fairhope Tipping Point’!
Georgia I think you are right about the tipping point. The residents are angry over the thugs in the council. We are going to take our town back
I guess this let’s all the Current City Commissioners off the hook after the swore to us before God that the would vote against the Fly Creek Project if elected??? Wrong!!! Y’all still are the same sorryass lying son of bitches that you were when running for a Fairhope City Commissioner spot. One thing the Ripp Report had shown me is that which candidates campaigned on the fact if they were elected that they would vote no in the Fly Creek Project. No matter if it passed or not. You all are which of liars no matter if this is stopped or not. The people will remember that all you lied even before being elected. That’s how stupid some of our citizens are. I do have a feeling that they are getting smarter though!!!
Yes, the people are getting smarter. They have no defense against the allegations that are being brought up. All they can say is Ripp is a fool. But Ripp keeps coming back every time they try to shut him up. He is a hero to Fairhope. His detractors say “Ripp you don’t live in Fairhope when he DOES live in Fairhope – just outside the Gerrymandered lines that keep minorities and other ones that threaten the current power structure of the crooked city.
Keep it up Ripp, you are making a difference.
This court order is only a delay in the process. The people wanting these apartments in are determined to get these in. Watch them change the drainage and be right back to work.
But I will say this: Paul Francis Ripp, I am proud of you in your relentless work in bringing to light the crooked council. This council is definitely in Corte’s pocket and you keep proving the crookedness of the council. I cannot wait to see these bums get voted out.
