Letter to Mayor Kennon of Orange Beach

Sept. 4, 2015
Dear Mayor Kennon, city council and city attorney:
I am sending you this very public letter in an effort to persuade you to investigate the allegations Baldwin County Legal Eagle, outlined in its freaky Friday edition Aug. 28, 15.
Mayor Kennon I visited your office, accompanied by a fellow concerned citizen, early this year. We expressed the concern we, as well as MANY others, had about the creditability of Orange Beach Municipal Judge Brackin.
Mayor you said that complaints about the Judge had always been reported to you outside your office and you did not consider them official. We immediately went on the record as filing our complaint, verbally, in your office.
You requested solid proof of such allegations and promised you would investigate any creditable complaint. At the time I knew of the incident in question, however I had provided the information to TV stations as well as the media, they failed to inform the general public, which has unfortunately become the norm.
The incident in question allowed a third offence DUI driver to leave the courtroom with a slap on the wrist, and get back in her vehicle. The allegations are spelled out in the BCLE letter; a few DETAILS were left out for investigators to uncover.
The legal precedent set by the judge is unrealistic and not consistent to Orange Beach standards of handling DUI violations. Any smart attorney, not intimidated or scared, of the judge could use this case as a defense of any DUI violation in Orange Beach. It also could affect past convictions the judge has passed down on similar charges, some resulting in jail time. If the same person was to get a 4th DUI or, god forbid kills or harms others, Orange Beach would be asked some very serious questions, this could result in Orange Beach being sued and held liable, and several attorneys have expressed the same possibility.
It is obvious the media would rather report about dolphins in the gulf than tackle anything that would upset the status quo. BCLE on the other hand has no such concerns and feels the public has the right to know of this double standard. BCLE will now file formal complaints with any and all authorities, however we feel it is the responsibility of Orange Beach Government to investigate these allegations.
BCLE respectfully request a response to this letter and the findings of any investigations the city conducts, BCLE followers are very interested in this miscarriage of justice and are equally curious how the Judge “spins” it.
