Here we go again Fauxhope discussing the same project with the same results for over 12 years. Fly Creek has been flooded with mud and sediment since the Publix project clear cut and killed every living thing on the Publix site. An executive for Publix once commented that “the developer dug a hole to fit the strip center and Publix in.”
The developer Author Corti is the major contributor to the Mayor and council and they have given him anything he wants, even during a moratorium on new construction.
The Ripp Report has been reporting on the abuses of the developer for over 12 years. Instead of rewriting everything we are just going to give you some of the posts:
The developer, Arthur Corti pulled a quick one on the Fairhope community and the council and Mayor Kant orchestrated it into a gift for the community. This little stunt transferred any liability associated with the developer to the city.
The gift that keeps on giving.
If Jack Burrell lips are moving he is lying and the last thing he wants is public participation where complaints about fly creek keep coming up. Burrell once explained that the mud and silt in Fly Creek was being forced in by the Bay. Fauxhope where water runs upstream!
After Publix came the apartments and the same opposition was ignored by council and Mayor. Built along Fly Creek these apartments were supposed to be luxury and a complex that would be a signature property. Within two years they sold the property and it suffered two occasions where flooding caused damage to the creek and apartments.
The 230-unit Retreat at Fairhope Village has been a source of contention for years in the city, where residents are concerned about aesthetics and traffic from such a large development and previous work adjacent to the site spurred similar lawsuits. Some believe Mayor Karin Wilson’s opposition to the project led to her victory over four-term incumbent Tim Kant.
About every 5 years we dredge out Fly Creek basin and yacht club. Millions spent on dredging out CONSTRUCTION runoff. Same developer, same issue, same result, NOTHING. DNA of the sediment in the creek is identified as coming from the Publix-Apartments. Still the city sits on its hands with its fingers in their ears.
Please take a trip up Parker road behind publix past the fire station and see the latest development the council and mayor again approved despite the lawsuits and continuous damage to the creek. You do not need a college degree to figure out that the drainage from this new cluster F goes down hill into the creek. How damn dumb are we or how corrupt is Fauxhope?
Friends of Fly Creek do not waste your time with ADEM, Baykeepers, City Council or Mayor. Join together in a lawsuit that is your only recourse. I suggest Attorney Adam Milam who has the experience and knowledge about the situation.
