Hard to believe a week later we are expecting another hurricane, IRMA, headed towards the United States. Landfall is expected in the Miami area and the destructive route may travel through the entire state of Florida. Please pray for those in Irmaโ€™s path and be prepared to help those in need as the storm passes.

Baldwin County can expect yet another influx of people as a result of hurricane Harvey and hurricane Irma. We are geographically centered between both storms and can certainly expect storm immigrants.
We should welcome them with open arms but we should also open our eyes to growth and infrastructure.

WHO THE HELL IS MIKE TURNER?

CHUCKEE did not clarify that Mr Turner is married to Pam Caudill a long standing board member of Fairhope Airport Authority, FAA, and dear friend of Jack Burrell another board member. He also failed to mention Pam is friends of Ray Hix another board member who shares ethics charges with Jack. Jack Burrell blocked the Mayors choice for the Airport Authority board member that would have replaced Pam Caudall.

Mr. Turner wants you to believe that his letter has nothing to do with Jack or the Airport. You have to be pretty damn stupid not to see through his false narrative. He claims to be an investigator of white collar crime in another life while he enjoys singing country western music in his present life. I hope he can sing better than he can investigate, see or read. Since he fell back into his past life to write this letter to the editor let me take a moment to suggest a few more things he should investigate, real close to home.

1. Your wife, Pam was on the board of the FAA when Mr Hix submitted his RFP, Bid, for a lease on an airplane hanger. She knew Mr Hix had inside information about the FAA since he had been a board member prior to his bidding.
2. Your wife, Pam has an aviation background in fact Jack Burrell said she was very knowledgeably, and has his back, and he had complete trust in her. However she failed to see that the RFP contained false information , provided by Mr. Hix. He claimed on the bid form that he owned more planes than he actually did and his fuel usage was grossly overestimated. Both these facts assisted Mr Hix in securing the bid.
3. As a board member your wife so no conflict of interest in Mr. Burrell flying free in Mr. Hixโ€™s jet prior to Mr Burrell overseeing and selecting Mr Hix as the winner.
4. Your wife so no problem with Mr. Hix not complying with the construction requirements set out in the RFP.
5. Your wife so no problems handing out special provisions for Mr. Hix to have is own fuel farm, something now being considered as foolish and counter productive to the fixed based operator who sells fuel.

Truth is Mike the whole FAA board turned a blind eye for their friends and fellow board members and are equally guilty of betraying the public trust.

Mike use those investigative powers and answer these questions and while your at it consult with Jack on the enclosed timeline: Since your so damn experienced in white collar crime lets see if you can understand FACTS. I will buy you a new guitar or give you the 5000 dollars that I have offered to the public if you can prove the timeline is totally inaccurate. You better stick to music maybe a

Thanks Mike for giving me the opportunity to again publish the timeline of events that surround the dirty dealings at the Airport that have cost Fairhope Millions. The council knows this to be true but does not want anyone in, public participation, to state the facts for the record.

Timeline Fairhope Airport Authority

December 16th 2015 Request for Advisory Opinion from the Alabama Ethics Commission, submitted by Dennis R. Bailey ESQ, of Rushton, Stakley, Johnston and Garrett, on behalf of Mid-Bay Air, LLC. The submittal includes Exhibit C-โ€ GROUND LEASE AND OPERATING AGREEMENTโ€, DATED THE 21ST DAY OF December, 2015. How did he send a lease dated the 21st on the 16th ? Exhibit C is the unsigned 21st lease, provided by Bailey to Ethics Commission in the form of the Request for Advisory Opinion.

December 17th 2015 Ground Lease and Operating Agreement, under Article XLVII, Limited Personal Guaranty, is the subject title. This is signed by H. Ray Hix as โ€œLimited Guarantorโ€, as well as Joe McEnerney, as Fairhope Airport Authority โ€œBoard Chairmanโ€ and Attested by Joshua P. Myrick, Fairhope Airport Authority โ€œAttorney/General Counselโ€.

December 17th 2015 Memorandum of Lease, notarized and recorded at the Baldwin County Probate 12/28/15. This Memorandum is signed by Joe McEnereney, as Fairhope Airport Authority โ€œ Board Chairmanโ€, as well as H. Ray Hix, as โ€œOperatorโ€, on behalf of Mid -Bay Air LLC.

December 21st 2015 EXHIBIT C [Ground Lease and Operating Agreement] sent to ethics commission unsigned and different than Dec 17th lease. The 21st lease, under Article XLVII, โ€œ Personal Guarantyโ€ is the subject title, whereas, on the Dec. 17th lease the title is โ€œLimited Personal Guarantyโ€. Both the Dec. 21st and the Dec. 17th leases contain title XLVII โ€œCONTINGENCY FOR ETHICS OPINIONโ€. the Dec. 21st Lease lists the title as CONTINGENCY FOR ETHICS OPINION the same as the Dec.17th lease however the sentence, โ€œIn the event of cancellation under this article only, the Authority will refund the security Deposit set forth in Article VII.โ€, appears in the 17th lease and is omitted in the 21st lease which was presented as Exhibit C. Clearly two separate leases.

Also the signature pages of the two leases are different, as the Dec. 17th, executed lease, is signed by โ€œLimited Guarantorโ€, H. Ray Hix, through the Dec. 21st lease, which was submitted to the Ethics Commission, states โ€œGuarantorโ€.

Letter of engagement, from Dennis R. Bailey ESQ, of Rushton, Stankley, Johnston and Garrett dated February 2, 2017, submitted to Mr. Joe McEnereney [Fairhope Airport Authority Chairman], regarding representation related to โ€œPotential Claims against Francis Rip [sp] by Fairhope Airport authorityโ€. Being as the same Dennis R. How can the Fairhope Authority engage Mr. Bailey, as he truly has a major conflict of interest and lacks credibility. Mr. McEnereney said the purpose of hiring Mr. Bailey was โ€œto head off any Ethics complaints involving Fairhope Airport Authority or itโ€™s membersโ€.

The Ethics Commission was contacted by a Fairhope resident who inquired about the leaseโ€™s in question. The Resident had every expectation of confidentiality, however later learned their information was shared by the Ethics Commission and Mr Dennis Bailey ESQ. The same Mr. Bailey hired by the Fairhope Airport Authority to quash any investigation involving his client or clients.

Feb. 8th 2016 EXHIBIT C was submitted to the Ethics Commission, that lease is dated Dec.21st and is different than the recorded lease Dec.17th

March 20 2017 The Affidavit by Joe Mc Enerney, Board Chairman, Fairhope Airport Authority, filed Probate, Baldwin County, 3/20/17 Clearly references Ground Lease and Operating Agreement dated Dec 17th 2015, as well as โ€œthat certain Memorandum of Lease dated December 17th, 2015โ€. The Ethics Advisory Opinion stated, under FACTS and ANALYSIS: โ€œIt should be pointed out facts regarding RFPโ€™s the letting of bids, etc. Occurred prior to this opinion being requested. The question is prospective in that while the bid process had been completed and Mr. Hixโ€™s company was the successful bidder, the contract has not been signed, pending review by the Alabama Ethics Commission. Execution of the lease is contingent upon a favorable opinion from the commission.โ€ The 21st lease was unsigned. The 17th lease was signed and executed, so the 17thlease does not comply with the Ethics Advisory Opinion.

These documents alone prove that the request for Advisory Opinion from the Alabama Ethics Commission on Dec. 16th 2015 contained false documents.

ADDITIONALLY: Their is an abundance of facts, documents and actions by the Fairhope Airport Authority that the RFP process was tainted and that Board members used inside information to better position themselves to obtain a lease.

The question at hand is not just the violation of the Ethics Advisory Opinion, it also involves the RFP process, which was manipulated. Both issues are of equal importance .

    We do need an Airport but at what cost?
    I read somewhere that 24% of the City’s budget goes to pay Airport debt. And the city doesn’t have the deed. Is that even possible.
    If it is …these politicians need to move on up to the Big League. They would fit right in!!

Then let’s first put the Airport property back in the City’s name where it should be in the first place (yes folks, we’ve been paying several hundreds of thousands of dollars each and every year for many, many years)! Or sell it to Jackass Burrell and his group with the agreement of the Entire Fairhope City Council’s resignation. We can hopefully get a good price and save all this money that we spend (WASTE) annually, (Over 20% of the city’s budget) this is stupid in the first place. Ridiculous if you ask me. Either way. It will be huge for Fairhope and we can make the city smell better Again especially the very raw stench that reaks from the city councilmen. Just saying.

    I am a realtor in Baldwin County. Fairhope discussions lately (homes for sale) have gone hand in hand with questions about the sewer system. Also there has been talk about the high school being overcrowded having to use “trailers”. Fairhope has some major problems to overcome. All I can say is that these are significant impediments to locating in Fairhope. What do I tell them about dumping human feces untreated in the bay? Should I lie and say it is nothing or just quote President Burrell and say it’s unavoidable and how things are done here?

      Tell any potential buyers that they are asking too much if they want a working sewer system and/or clean water/stench-free air to breathe. Tell them that Kant, Burrell & Boone have provided them with a lovely flower clock reminiscent of Michael Jackson’s Neverland, soccer fields, an amphitheater and that their tax dollars will support the airport, whether or not they have an airplane. What more could any homebuyer (with or without children) want? Burrell may have finally gone too far because actual media outlets are suddenly paying attention to this mess that he has engineered.

  13. So we now know Jack reads the Ripp Report, based on his fury about the comment made a couple of weeks ago that said he had been seen at Lulu’s in a compromising situation. True or not, I don’t know. But I know this: Jack seems to think he is the only person who has the right to go around saying things about other people that’s not true. Does he honestly think that all of us here in Fairhope don’t know someone who knows someone else who has heard something derogatory, inflammatory, and defamatory about the Mayor and others in her orbit, including her own family? There are few things more enraging than utter hypocrisy and Jack has fine-tuned hypocrisy to an art.

    I also want to thank you, Mr. Ripp, for speaking up during the Council meeting and not letting the bullies sway you from your right.

    Jack Burrell is not a man – he is a coward that tries to intimidate people to get his way. I do not know of anyone that respects him at all. We the citizens are embarrassed to have him represent Fairhope in any capacity. His behavior has gotten beyond acceptable. His screaming & smart aleck comments are beyond disgusting – and I no longer respect the other 4 men on the council for not speaking up & sitting there – mostly just looking down – they have no guts & are not true men either. I do not care what their occupations are & do not care what church & civic organizations they are members of. It is all for show – none of them should be representing Fairhope

    • Frankly too much blather about mostly nothing. The important issue of the day was the future of the marina and the mayor had her way, desrvedly so, because her minions advanced reasonable arguments and apparently swayed at least Boone and Burrell and myself (no I wasn’t physically there) . That is how things should be going instead of the hysteria, name calling, and stupid posturing. Generally her honor accomplished more this week than any I remember. I think the fighting lawsuit and the eavesdropping inquiry are both overblown since no one was really physically hurt and the it’s not like the email stuff concerns national secrets.
      I think the big item, dealing with the big stink, is moving along judiciously. Hopefully the council and Mayor will go big and cough up enough $ to address the problem. The stink problem and the airport debt I lay squarely at the feet of the honorable Mr Kant with maybe a little reprimand to B&B since they were there(here) for the last bit of it. BTW the big problem with the airport was paying top $ to buy all the land and stick us with a big bill. Now that the horses are out of the barn it is silly to quit paying the note and lose what we have. We are paying for the sins of the past and there are no good alternatives. Kind of like N Korea.

        If the City took back control of the airport, couldn’t the City then lease to an FBO for a lot of money? I tried, many years ago, to lease the Destin Airport and run the FBO but was outbid by another company. Lesson learned: we should have bid more in the beginning!

        The Monroeville, Alabama airport is leased to an FBO that does very well. They have the Blue Angels and other training jets flying in and purchasing fuel and supplies and they are very beloved by the citizens of Monroe County because of the revenue stream that they bring. The owner of the FBO even cooks meals for the pilots to encourage them to land and purchase their fuel there. The Fairhope airport is also well located; the City could do well encouraging Military aircraft and others to stop and refuel and spend some time here.

        The Fairhope Marina will never make a lot of money for the city, but the intent seems to be the same; if we can provide a welcoming environment to visitors arriving by water, we will create more goodwill.
        Why is it that Burrell is the last/only word on airport matters, and who is making the money from fuel sales? I think that the only reason that Burrell has approved the Marina deal is to divert attention from the Airport deal, but what do these ‘deals’ mean to Fairhope taxpayers?

          You are 90% right, the marina will make money and the city should manage it. The airport fuel is suppose to be sold through the fbo however sweet heart deals allowed two select tenants to have their own fuel farms, one being Ray Hix the Board member. Now as I understand it the policy for fuel farms has changed and they will not be granted. However Hix will keep his?, it is contrary to the fbo. Their is little or no promotion of the airport it has become a coffee club for the 1%. The city should lease it and dissolve the board, it will be better run. Burrell should be kicked off the council for his actions at the airport, if not convicted.

        • Airport title is more of a red herring. The City can retake title anytime it chooses. There were logical reasons given why taking on the title was not done. One was liability. How would you feel about a million dollar wrongful death lawsuit ? What about a ten million dollar one ? I would certainly love for the airport to be leased out but that may be easier said than done.
          If there are sweetheart fuel deals I would like to know why they were made. I thought the ones with the private fuel farms still had to pay the city
          It’s due,but I won’t swear to that. The thing we should all be focused on are the electrical and sewer systems. They both need big $. Everyone is focused only on the sewer, hard not to, it’s a bad visual, but a blackout won’t go down so well either. I am for whoever will deal with this big stuff
          unless they badmouth my hubby in which case, we’ll let’s just say there are limits. The Mayor and council are acting like they want to deal with this. I’ll wait and see who does what. Paul , why don’t you and Jack rent the Nix Center and have an unrecorded no holds barred debate and charge $5/person to attend ? Maybe charge another $5/person to vote on who won. Proceeds to go to the local charity or government of your choice, all should be tax deductible.
